CLT night-shift premium — how it works

For urban workers, the Brazilian CLT (art. 73) treats night work as the stretch between 22:00 and 05:00, and it owes a premium of at least +20% over the regular hourly wage. There is a second twist: the night hour counts as 52 minutes 30 seconds rather than 60, so 7 actual clock hours turn into 8 paid night hours. Rural work follows its own ranges under art. 7º of Law 5.889/1973. Cattle ranching runs 20:00-04:00, crop farming 21:00-05:00, the premium climbs to +25%, and the hour stays the full 60 minutes.

Say an urban worker earns R$ 20 an hour and clocks 7 night hours: 7 × (60/52.5) × 20 × 1.20 = R$ 192.00, against R$ 140 for the same time at the regular rate. Pay it habitually and the premium incorporates into the salary base (TST Súmula 60, I). Should the schedule later change, the night premium amount sticks around (princípio da não-aplicação retroativa).

Brazilian context

Think industrial shift work, hospital staff, private security (vigilantes), surveillance and patrol services, logistics, call centres. If a continuous night shift bleeds past 05:00, those extra hours still count as night hours (TST Súmula 60, II, the prorrogação). And because the premium is part of habitual remuneration, it shows up in vacation, 13th salary, FGTS deposits and INSS.

FAQ

Does the night premium count for FGTS and 13th salary? Yes. As habitual remuneration, it joins the salary base for FGTS, 13th, vacation and INSS.

What if I work past 05:00? Hours after 05:00 that continue the same night shift keep the night premium (TST Súmula 60, II).

Can the +20% be replaced by a fixed bonus? Only through collective bargaining, and never below the legal +20% (or +25% rural). A worker cannot waive it on their own.

Does the reduced 52'30" hour apply to rural workers? No. The reduced night hour is an urban benefit; rural hours stay at 60 minutes.
