Interstate ICMS: how the rate is applied

When goods cross state lines, Brazilian ICMS applies a specific interstate rate. It's 7% if the goods leave the South or Southeast (except ES) heading to the North, Northeast, Centre-West or Espírito Santo, and 12% for everything else. The math itself is just ICMS = value · rate. Take a R$ 1,000 sale from SP to BA at 7%: that produces R$ 70 of ICMS at origin. Things change once the buyer is the final consumer. EC 87/2015 brought in the DIFAL, the rate differential, where the destination state collects the gap between its internal rate and the interstate rate. That gap was shared between origin and destination through a transition that wrapped up in 2019.

Brazilian context

This rule sits at the heart of national e-commerce, and it matters just as much to carriers, marketplaces like Mercado Livre, Magalu and Amazon BR, and reverse logistics. Convênio ICMS 142/2018 also spells out which products fall under ICMS-ST (tax substitution), the arrangement where one taxpayer in the chain pays on behalf of the rest. The tax reform under EC 132/2023 phases ICMS out between 2026 and 2032 and replaces it with the destination-based IBS, which puts an end to the long-running fight over tax revenue between origin and destination states.

FAQ

What is the rate for imported goods? It's 4% on any interstate operation involving an imported product (Resolução do Senado 13/2012), as long as the industrialisation done after import stays below 40%.

Who pays the DIFAL? If the buyer is a non-taxpayer (a final consumer), the seller pays it. If the buyer is an ICMS taxpayer, the buyer handles it in its own state.

Does interstate ICMS apply to services? Only to interstate transport and communication. Other services fall under ISS, which is a municipal tax.
