Brazilian travel authorization for minors: a complete guide

A autorização de viagem para menor is the written permission required by Brazilian law for a child or teenager to travel without one or both parents. The legal framework is set by the Estatuto da Criança e do Adolescente — ECA (Law 8.069/1990), articles 83 to 85, and detailed by Resolução CNJ 295/2019, which standardized the rules and forms nationwide. Border police (Polícia Federal) and airlines are obliged to check the document at boarding, and a minor who lacks the proper authorization is barred from travelling.

Two key distinctions structure the rules: domestic vs. international travel, and under 16 vs. 16-17 years old. The requirements grow stricter for younger children and for international destinations.

Domestic travel inside Brazil

  • A minor of any age travelling with one of the parents needs only an ID — no authorization from the other parent is required.
  • A child under 12 travelling with a relative up to the third degree (grandparents, uncles, aunts, adult siblings) needs a written authorization signed by at least one of the parents with firma reconhecida.
  • A child under 12 travelling with a non-relative or unaccompanied needs a judicial authorization from the local Vara da Infância (Children's Court).
  • From 12 to 17, domestic travel without parents is generally free of authorization, although airlines often have internal rules (unaccompanied-minor forms).

International travel

For travel outside Brazil, the rules are stricter under ECA articles 84-85:

  • Minor with both parents: no authorization needed.
  • Minor with one parent only: requires written authorization from the absent parent, with firma reconhecida em cartório (notarized signature).
  • Minor with a third party or unaccompanied: requires written authorization from both parents, notarized, or a judicial authorization.
  • If a parent is deceased, the death certificate substitutes the authorization. If parental authority belongs exclusively to one parent (sole custody), the corresponding court ruling proves the fact.

Resolução CNJ 295/2019 sets the standard validity period at two years from issuance, unless a shorter term is specified by the parents. Specific travel authorizations (for one defined trip) lose their validity at the end of that trip.

e-Notariado and the digital authorization

Since 2020, the Brazilian notary system (Colégio Notarial do Brasil) allows the authorization to be signed electronically through the e-Notariado platform using an ICP-Brasil qualified certificate. The digital document has the same legal force as the notarized paper version and can be presented on a smartphone at boarding. Parents living abroad can sign through a Brazilian consulate.

Mandatory content

The authorization must contain: full identification of the minor (name, date of birth, RG/CPF, parents' names); identification of the parents (name, RG, CPF, marital status); identification of the companion (if any) — name, RG, CPF and relationship; the destination(s) and travel dates; the express clause authorizing the trip and the entry/exit of national territory (for international travel); and signatures with firma reconhecida of the authorizing parent(s). For international travel, a bilingual form (Portuguese plus the destination's language) is strongly recommended to ease connections.

Frequently asked questions

My child will travel with an uncle for school break — is authorization needed? For domestic flights with a child under 12, yes — written authorization from one parent with firma reconhecida. For international travel, both parents must authorize.

One of the parents has passed away — what do we do? The death certificate replaces the authorization. Bring the original or a recent certified copy and, for international flights, present it together with the surviving parent's authorization.

The other parent refuses to sign — is there any way out? Yes. The interested party can file a suprimento judicial de consentimento with the local Children's Court (Vara da Infância), which may authorize the trip if the refusal is found to be unreasonable.

Do airlines require their own forms? Yes — Latam, Gol, Azul and international carriers all have internal unaccompanied-minor (UM) forms in addition to the legal authorization. Check the airline's website before the travel date.
