MP code: how Brazil's Public Prosecutor's Office numbers its cases

In Brazil, "MP" stands for Ministério Público — the Public Prosecutor's Office — an independent constitutional institution that defends the legal order, the democratic regime, and society's collective interests. Article 127 of the 1988 Federal Constitution defines the MP as permanent and essential to the judicial function, but functionally autonomous from the three branches of government (Executive, Legislative, Judiciary).

Every administrative proceeding opened by the MP — civil inquiry, preparatory procedure, complaint reception — receives an internal MP protocol number, distinct from the CNJ judicial case number that may follow if litigation is filed. Careers, ranks, and chief prosecutors

Entry is by competitive public exam (concurso). First-instance prosecutors are called Promotor de Justiça (state MP) or Procurador da República (federal MPF). On promotion they become Procurador de Justiça (state second instance) or Procurador Regional da República (federal second instance).

Each MPE is headed by a PGJ (Procurador-Geral de Justiça), chosen by the state governor from a triple list submitted by the prosecutors' class. The MPF is headed by the PGR (Procurador-Geral da República) — nominated by the President of Brazil (with or without a triple list), confirmed by the Senate, two-year term renewable.

Investigative tools: IC, TAC, ACP

• IC (Inquérito Civil) — civil inquiry to gather evidence on collective rights violations (consumer, environmental, urban planning). Each IC has its own MP protocol number.
• Procedimento Preparatório — pre-inquiry phase, usually 90 days, to decide whether to open an IC.

FAQ

Can an individual file an ACP through the MP? No — the MP acts as an institution, not on a private citizen's behalf. Citizens can file a popular action (ação popular) or report facts to the MP, which then decides whether to act.

Is the MP protocol number the same as the CNJ case number? No. The MP protocol identifies the internal proceeding; the CNJ number is assigned only when a lawsuit is filed in court. They cross-reference but are different.

Are MP proceedings public? Generally yes, under the LAI (Access to Information Law). Exceptions: ongoing criminal inquiries, victim protection, business secrets — sealed under specific legal grounds.

What's the difference between MP and Public Defender (Defensoria Pública)? Both are autonomous functions defined by the Constitution, but the MP prosecutes and defends collective interests, while the Defensoria assists individuals who cannot afford a lawyer.
